DMCA Takedown Policy

Introduction

NovelFlame respects the intellectual property rights of others and complies with the Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512. This policy describes how copyright holders can report alleged infringement and how we respond to valid DMCA notices. While the vast majority of content on our platform is AI-generated fiction, we take all intellectual property claims seriously.

Filing a DMCA Notice

If you believe that content on NovelFlame infringes your copyright, you may submit a written DMCA takedown notice to our designated agent. Your notice must include the following elements as required by 17 U.S.C. § 512(c)(3):

  • A physical or electronic signature of the copyright owner or a person authorized to act on their behalf
  • Identification of the copyrighted work claimed to have been infringed, or a representative list if multiple works are involved
  • Identification of the material that is claimed to be infringing and information reasonably sufficient to permit us to locate the material (such as a URL or description)
  • Your contact information, including name, address, telephone number, and email address
  • A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law
  • A statement, made under penalty of perjury, that the information in the notification is accurate and that you are the copyright owner or authorized to act on behalf of the owner

We will acknowledge receipt of your notice within 2 business days and will respond with our determination within 10 business days.

Counter-Notification Process

If you believe that material removed in response to a DMCA notice was removed in error or is not infringing, you may submit a written counter-notification to our designated agent. Your counter-notification must include:

  • Your physical or electronic signature
  • Identification of the material that was removed and the location where it appeared before removal
  • A statement under penalty of perjury that you have a good faith belief the material was removed as a result of mistake or misidentification
  • Your name, address, and telephone number, and a statement consenting to the jurisdiction of the federal district court for the judicial district in which your address is located (or Clark County, Nevada, if your address is outside the US)

Upon receipt of a valid counter-notification, we will forward it to the original complainant. If the complainant does not file a court action within 10 business days, we may restore the removed material.

Repeat Infringer Policy

In accordance with the DMCA, NovelFlame maintains a policy for the termination of accounts of users who are repeat infringers. Users who receive three or more valid DMCA notices may have their accounts permanently terminated at our discretion. We reserve the right to terminate accounts after fewer notices in cases of egregious or willful infringement.

Good Faith Requirement

Please be aware that under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material is infringing, or that it was removed by mistake, may be subject to liability for damages, including costs and attorneys' fees. We encourage all parties to consult with legal counsel before submitting a DMCA notice or counter-notification.
